Supreme Court disposes of plea against Mathura demolition drive | India News – Times of India

NEW DELHI: The Supreme Court on Monday disposed of a plea filed against demolition drive near Krishna Janmabhoomi in Mathura to remove alleged encroachment on government land and refused to grant any protection to those removed from the land and asked them to raise their grievances before lower court where the suit is pending.

A bench of Justices Aniruddha Bose, Sanjay Kumar and S V N Bhatti turned down plea to extend its status quo order on demolitiondrive and allowed the petitioners to approach suit court where title dispute over the land is pending.

The Centre informed the court that the petitioner had not approached the court with clean hands and all the required legal procedure was followed before removing the encroachers.
The top court had on August 16 stayed the demolition drive and directed that status quo be maintained for 10 days which expired on August 25.

Countering the petition, the Centre in its affidavit refuted all the allegations of the petitioner that the demolition drive was illegal. “He deliberately suppressed from this court that the eviction proceedings in the subject properties were undertaken pursuant to compliance of the due process of law as contemplated under the Public Premises (Eviction of Unauthorised Occupants)Act. The said fact clearly establishes that the petitioner has not approached this court with clean hands and behind the facade of violation of his fundamental rights, the petitioner is seeking to pursue some collateral of hidden agenda,” the Centre said.
