Delhi HC stays order to give FIR copy to Parliament breach accused | India News – Times of India



NEW DELHI: The Delhi HC stayed Friday a trial court’s order directing police to provide a copy of the Parliament breach FIR to one of the suspects, Neelam. Justice Swarana Kanta Sharma issued notice to Neelam and sought her response to Delhi police‘s plea challenging the trial court’s Thursday order. “Execution of the order stayed till the next date of hearing,” the HC said and listed the matter for January 4.
In their appeal, the police have cited the Supreme Court‘s directions that in sensitive matters, suspects must approach the police chief, who will form a committee to decide if a copy of the FIR can be given. If denied, the accused can move court for relief. According to the police’s appeal, the trial court erred in asking for FIR copy to be provided in this case. The trial court had asked the investigating officer to hand over the FIR copy to Neelam’s counsel. It did so while extending the police custody of Neelam and three other breach case suspects.
