NAGPUR: The Nagpur bench of Bombay High Court on Friday directed premature release of underworld don Arun Gawli. A division bench comprising Justices Vinay Joshi and Vrushali Joshi allowed the criminal petition filed by the gangster challenging rejection of his claim to be released prematurely in view of government notification of January 10, 2006.
The govt has been directed to take decision on his release within four weeks from the date of order.
Gawli was awarded life imprisonment by a sessions court in Mumbai on August 3, 2012 along with 11 others for murdering former Shiv Sena MLA Kamlakar Jamsandekar.
A Special Maharashtra Control of Organized Crime Act court (MCOCA) while pronouncing the judgment awarded rigorous life imprisonment and also imposed a fine of Rs 17 lakhs on him.
The earlier application preferred by Gawli through counsel Mir Nagman Ali was rejected by the respondents, including the jail authorities, contending that the govt had come up with a fresh notification on December 1, 2015, by which a convict under MCOCA Act was excluded from the benefit of January 2006 policy.
