Court questions ‘unbelievable’ encounter story, acquits 3 in UP | India News – Times of India



BIJNOR: Punching holes in a police case against three alleged auto lifters who were arrested following an “encounter” in Amroha Monday night, the court of chief judicial magistrate (CJM) Om Pal Singh not only cancelled the remand of the men but also acquitted them of charges that they had attempted to murder cops, reports Harveer Dabas.
Chief legal aid defence counsel Devendra Pal said Thursday, “Court questioned the police investigation and pointed to lapses in its findings.CJM observed the encounter was strange and surprising. It is unbelievable no police personnel were injured but cops could hit the leg of one of the accused in the night’s darkness…” Pal added: “The CJM further observed from the case diary that two bullets had been fired by cops. He then asked, ‘if one bullet hit one of the accused where did the second go? How could it not be found when cops could easily locate shells fired by the accused’. Also, why many crucial points in the diary were left unanswered.”
Police claimed the trio were on a bike around 11pm. When cops tried to stop them, they “fired back” and tried to escape. There were cases of robbery, attempt to murder and theft against them, cops said.
