NEW DELHI: A Delhi court on Wednesday ordered the framing of charges against Indian National Congress functionary Jagdish Tytler in the killing of three persons in the Pul Bangash area during the 1984 anti-Sikh riots.
The court of Special Judge Rakesh Syal directed the framing of charges against Tytler under Sections 143 (unlawful assembly), 147 (rioting), 153A (promoting enmity between different groups), 188 (disobedience of the order duly promulgated by a public servant), 295 (injuring or defiling a place of worship), 436 (mischief by fire or explosive substance with intent to destroy house), 451 (house trespass), 380 (theft in dwelling house), 149 (every member of unlawful assembly guilty of offence committed in prosecution of common object), 302 (murder), and 109 (abetment) of the Indian Penal Code.
“Sufficient grounds are there to proceed against the accused person,” said Special Judge Rakesh Syal.
Meanwhile, the court discharged him for the offences under Section 148 (rioting armed with deadly weapon).
The court has now listed the matter on September 13 when Tytler would have to physically appear before the court and charges would be formally framed against him.
On July 26, 2023, the court had summoned Tytler on August 5 in connection with the Pul Bangash killings during the 1984 riots.
The court issued summons after taking cognisance of a chargesheet in the case. The CBI on May 20, 2023, filed a chargesheet against Tytler in the case.
On July 21, 2023, the court granted time to the CBI to take instructions on the issue of bringing a complaint under Section 195 CrPC filed by a public servant for violation of his orders by the accused.
On July 7, 2023, the court reserved order on cognisance of the supplementary chargesheet against Tytler.
The court on June 30, 2023, summoned the trial court records related to the Pul Bangash case and the CBI’s FIR in the matter against Tytler.
Background of the case:
On June 2, 2023, a Delhi court approved a supplementary chargesheet filed by CBI against Tytler in the 1984 anti-Sikh riots case.
In April 2023, Tytler had appeared before the CBI and given samples of his voice in connection with the case for the Central Forensic Science Laboratory to examine.
In May 2023, the CBI filed a chargesheet against Tytler in a case related to the 1984 anti-Sikh riots, alleging that he instigated the mob to attack a gurdwara in Delhi in which three Sikhs were burnt alive.
