CBI claims ‘evidence tampering’

KOLKATA: CBI, probing the “larger conspiracy” of destruction of evidence in connection with the rape and murder of a 31-year-old intern at RG Kar Medical College and Hospital, claimed before the ACJM court on Wednesday that “some false records pertaining to the case were created at Tala police station“.
CBI also claimed former Tala police station officer-in-charge Abhijit Mandal spoke to former RG Kar Medical College principal Sandip Ghosh a number of times on August 9, the day of the crime.It claimed that the duo’s custodial interrogation had revealed “new and additional facts”, including that some documents were “altered” at the police station.
Lawyers representing Mandal and Ghosh asked CBI to provide evidence instead of making allegations in court. They said it was natural for the hospital head (Ghosh) to speak to the officer-in-charge following the rape and murder.
CBI submitted a report to the court in a sealed cover, and demanded judicial custody of the two accused till September 30. On Sept 17, CBI had submitted a status report on the probe to SC, which had said the agency was exploring the possibility of evidence being destroyed.
Mandal’s lawyer Ayan Bhattacharya argued that remand note did not mention Mandal’s involvement in the rape and murder. “The allegation of dereliction of duty, if found true, could at best invite sections applicable for public servants disobeying law and causing disappearance of evidence. These are bailable sections,” Bhattacharya said.
“The court should not consider the sealed cover. If there is a case diary, they should refer to that alone,” Ghosh’s lawyer Zohaib Rauf said.
Meanwhile, CBI Wednesday interrogated Apurba Biswas, the doctor who headed the panel that performed the post-mortem exam on the victim. Sushanta Roy, another doctor, who was allegedly present at RG Kar on August 9, was asked to appear before CBI. Roy denied getting summons.
