According to documents acquired by PEOPLE, the Modern Family veteran, 51, and Magic Mike actor, 47, agreed to divide their assets based on their prenuptial agreement.
The ex-couple did not share “any community property” during their marriage.The agreement also stipulates that Vergara and Manganiello would keep their personal assets, such as jewellery, clothing, and “miscellaneous personal effects,” as well as any earnings made after their separation on July 2, 2023.
The couple has waived their claim to spousal support.
The filing comes roughly two months after the former couple agreed to finalize their divorce.
According to a file acquired by PEOPLE in February, the divorce case is progressing as an uncontested action, which means that both parties attended and “entered into a written agreement regarding their property and marriage… which is being or has been submitted to the court.”
Manganiello urged the court to terminate spousal support for both parties, and legal fees will be ordered in accordance with the proposed decision, according to the documents.
In July, the couple announced their breakup in a joint statement to Page Six. The former couple married in November 2015 at the Breakers Resort in Palm Beach, Florida, and had been together for seven years before they announced their split.
“We have made the difficult decision to divorce,” the now-ex stated. “As two people that love and care for one another very much, we politely ask for respect for our privacy at this time as we navigate this new phase of our lives.”
Two days after the joint statement, Manganiello filed for divorce from America’s Got Talent presenter, alleging “irreconcilable differences.” He cited the date of separation as July 2 and mentioned that they had a prenup.
Vergara later requested in a second motion that the court uphold the former couple’s prenuptial agreement.
In January, Vergara told Spanish newspaper El País that she and Manganiello disagreed on increasing their family, which led to their divorce.
“My marriage ended because my husband was younger; he wanted to have children, and I didn’t want to be an elderly mother,” the Griselda star stated. “I think it’s unfair to the baby. I admire whoever does it, but it’s not for me anymore.”
Vergara, who has son Manolo with ex-husband Joe Gonzalez, added, “I had a son at 19, who is now 32, and I’m ready to be a grandmother, not a mother. So, if love comes along, he must bring his own children.
“I’m almost in menopause; it’s the natural way of things,” she said. “When my son becomes a dad, let him bring the baby to me for a while and then I’ll give it back to him and go on with my life; that’s what I have to do.”
The two have since separated. Manganiello is dating actress Caitlin O’Connor, while Vergara has been photographed on several outings with orthopedic physician Justin Saliman in recent months.
