Punjab ex-DIG gets 7-year RI, ex-DSP life in 1993 fake encounter case | India News – Times of India



MOHALI: Thirty-one years after a fake encounter, the family of vegetable vendor Gulshan Kumar, who had been abducted and killed, got a compensation of Rs 2 lakh as a special CBI court of judge RK Gupta in Mohali on Friday sentenced former Punjab police DIG Dilbagh Singh to seven years’ rigorous imprisonment (RI) and former DSP Gurbachan Singh to life term in the 1993 case.
Counsel for the victims Sarabjeet Singh Verka said the court also fined the two convicts Rs 3.75 lakh for the extra-judicial killing of Gulshan.
While appearing for CBI, counsel Anmol Narang said Gurbachan has been sentenced to life term under IPC Section 302 with a fine of Rs 2 lakh; to seven years of RI under Section 364 with a fine of Rs 50,000; to four years of RI under Section 201 with a fine of Rs 50,000; and to two years of RI under Section 218 with a fine of Rs 25,000 totalling to Rs 3.25 lakh. Dilbagh has been sentenced to a seven-year jail term under IPC Section 364 with a fine of Rs 50,000.
The court ordered compensation of Rs 2 lakh to be awarded to the victim’s family from the fine collected from the convicts, Narang said.
During inquiry, Gulshan’s father Chaman Lal deposed that his son was abducted by a police party led by Dilbagh — then DSP City (Tarn Taran) — on June 22, 1993 from his residence and later killed in a fake encounter on July 22, 1993.
Police cremated Gulshan’s body at the cremation ground in Tarn Taran on the same day without informing the family members. A case was registered by CBI against Dilbagh and four others on Feb 28, 1997.
Narang said a chargesheet was filed on May 7, 1999 by the CBI against then DSP Dilbagh, then inspector Gurbachan, then ASI Arjun Singh, then ASI Devinder Singh and then SI Balbir Singh. Arjun, Devinder and Balbir died during trial. The charges were framed against the accused on May 7, 2000. After the trial, the court held both the accused guilty and pronounced the sentence accordingly. As many as 32 witnesses were cited by the CBI.
During the trial, it was proved by cogent evidence of eyewitnesses that accused persons — Dilbagh Singh and Gurbachan Singh — among others abducted Gulshan from his house on June 22, 1993, kept him in illegal detention/confinement and killed him on July 22, 1993.
The evidence presented shows that the accused police officers staged the murder as an encounter, with testimonies and documents proving the false narratives created by the guilty police officials.
